TERMS & CONDITIONS

These Terms and Conditions set out the terms of the agreement between you and Sparky Pty. Ltd. 432, San Mateo Avenue, Mindura, Victoria, Australia - 3500. In this document, the terms "we" "us" and "our" refer to "Sparky".

Purchase Policy

All Sparky prices displayed on the website are in Australian currency and includes GST. We accept Visa,MasterCard, Sparky gift card/voucher and PayPal (eBay purchases only). All sale prices during promotions are shown alongside the Recommended Retail Price (RRP) for your reference. Prices are subject to change, and Sparky reserves the right to amend prices without further notifications. Full payment of purchase must be made prior to delivery.

In an effort to keep your payment information secure, we have collaborated with a global omnichannel payment provider to process secure credit card payments worldwide. We do not retain your credit card information after your order is finalised. All sensitive information concerning financial materials are encrypted. A confirmation of the purchase order will be sent to you via email. Please ensure that you provide accurate and up to date contact information should we need to confirm the security of your order.

4.1 Orders will only be processed after the entire order value, including GST, has been paid in full.

4.2 Sparky will offer price matching during promotional periods provided that the order has not been delivered or collected and the invoice purchased is within 60 days of the promotional period. If the invoice is paid in full, you will receive a credit note for the difference to be used on any new invoice. If it is not paid in full, we will reduce the invoice to match the new price as long as you notify us within the time period mentioned above.

4.3 The final delivery charge for your order will be calculated at the time of checkout if purchasing online or at the point of purchase when confirming delivery for an in-store purchase.

4.4 Special orders cannot be cancelled or altered once the order is placed, and a termination fee of fifty per cent (50%) of the total purchase value is applicable (Special order options are not available online as we would require our customers to sign off on custom orders).

4.5 Sparky will hold your order up to 6 months with full payment finalised within 90 days of purchase; otherwise, your order will incur a storage fee of $5 per cubic meter per day thereafter. If the goods are not collected or delivered within the specified period, Sparky has the right to cancel the order.

4.6 Prices for Products change from time to time due to price hikes and surcharges in the supply chain, and we do not provide any notice of these changes.

4.7 All purchase orders must be finalised and paid in full prior to confirmation of delivery or collection.

4.8 Sparky will not allow discounts to be entered after an order has been placed and finalised. Therefore, all promotional discounts must be used/entered at point of purchase.

4.9 Sparky aims for all orders to be shipped and delivered within 1-3 weeks of becoming available. The estimated time of arrival (ETA) of the product(s) is an approximation only and is subject to change. We do try our utmost best to communicate possible changes when it becomes available to us.

4.10 The Sparky Luxe membership is valid for 2 years and is non-refundable for cash or credit. Promotions and further discounts in relation to the membership are at the discretion of Sparky and may be withdrawn at any time. Clearance items and specific promotions such as Queens Birthday, EOFY and Boxing Day campaigns will be excluded from additional membership discounts.

4.11 Unless otherwise stated, Sparky Gift Cards/credit notes/Vouchers purchased are valid for thirty-six (36) months after their date of purchase. Any balance remaining after its expiry will be forfeited and will automatically become the property of Sparky. Extensions will not be provided.

4.12 If you have changed your mind on your order, you have the following options: If the balance is not finalised, you may remove, or exchange items from your order to the value paid initially; however, the balance may not be reduced to less than the initial deposit you paid. If the order is paid in full, you will receive a credit note for the full purchased amount of the invoice, valid for thirty-six (36) months. If you want to exchange an item on your order for another, you may do so, provided it is within the conditions mentioned.

4.13 If you choose to terminate your lay-by or standard purchase order before taking possession, there will be a thirty per cent cancellation fee (30%) of the total purchase value.

4.14 If you change your mind after receiving your item/s, we accept the return only if it is in its original unopened packaging and the product is returned within 7 days of delivery or collection. However, a 30% cancellation fee will be applied to the total returned item/s should you opt for a refund and not a store credit.

4.15 Once you have received your items, regretfully, Sparky cannot accept the return of unboxed, assembled, soiled goods; if you have changed your mind or deemed you had no use for them.

4.16 Sparky must be notified of any imperfection in the product(s) within seventy-two (72) hours of the goods being delivered or collected. Sparky does not guarantee that an item will be replaced if the appeal is seen as unreasonable or outside the variation understanding. *

4.17 Sparky needs to be notified of any imperfection/dissatisfactions of the delivered products, substantiated with photographic or video proof. We reserve the right to decline your claim if you reject goods without adequate evidence.

4.18 All quotes are valid until the date stated on the quote. All quotes must be written and issued on our system to be redeemed. Verbal quotes or quotes that are not on our system are not valid. If there is no end date stated on the quote, then it is valid until the end of the promotion that was active when the quote was issued.

4.19 Sparky may reject all or any part of your order or restrict the quantity of certain goods without liability to you for the following reasons:

• - A product in that order is discontinued and unavailable
• - The shipping fee quoted and payable by Sparky is seen as excessive
• - There is an error in the price, product or the description displayed on the site or instore
• - The order triggers fraud prevention protocols or
• - We believe that to do so is otherwise necessary or expedient

We support and act in accordance with the Australian Privacy Principles in the Privacy Act 1988 (Cth), which defines standards for the collection, storage, distribution and use of personal information which we obtain as part of our business operations. Where your personal information is collected, it will be done so directly, with your permission, whether that is in person, by telephone or over the Internet. If you choose not to provide your personal information to us, it may restrict our ability to provide you with the service you require.

This site uses an analytics system to help improve usability and the customer experience. We may record mouse clicks, mouse movements and scrolling activity. We may record keystroke information that you voluntarily enter on this website. We do not track this activity on any site that does not use our analytics system. However, in some cases, we may refuse to grant you access due to interference with the privacy of others or if it would result in a breach of confidentiality, laid to us by the government law bodies. In most cases, if you have purchased at Sparky Online or in-store, you will have access to the information we hold about you.

Sparky may make necessary changes to this Privacy Policy from time to time for any reason. We will publish those changes on this page. It is your responsibility to comply with any changes made to the Privacy Policy and your continued use of our facilities constitutes your acceptance of the revised Policy.
